There are many ways to resolve legal issues. Only 3% to 5% of legal cases actually go to a trial. That means that most are settled out of court by negotiations, mediations, arbitration, collaboration, and many other dispute resolution methods. Each of these methods have rules of procedures and evidence just like litigation along with all the normal court rules. If you still have issues that you need to discuss with a 3rd-party, mediation is a good process for many cases. It usually costs less than litigation and can prevent many of the emotionally draining aspects of the legal system, because the parties are deciding it and not the Judge or legal system. An attorney is still very useful in this process.
If you want to keep most of the facts and actions out of court and the public, the parties can agree to collaboration or arbitration. If your situation needs a complex multi-step process with the assistance of attorneys and keeping everything still private, collaborative law could be the best option. This is similar to mediation, but all parties must have attorneys along with other case specific professionals to guide the process.
